TERMS AND CONDITIONS AGREEMENT BETWEEN WEKA INTERNATIONAL LTD AND ITS USERS/CLIENTS
Terms and conditions of use – refer to the policy and rules which regulate the use of this site.
- User – refers to any person, you, who enter, read, and/or uses this site and all that it has to offer.Seller – refers to Weka International Ltd and those of which are employed by Weka International Ltd.
- Service Provider (supplier) – refers to any person not employed directly by Weka International Ltd that provides services under the guidance of Weka International Ltd. May also be referred to as a 3rd Party or 3rd Party Service
- Website (site) – refers to any person which enters, accesses and/or utilizes this
- Material/s – refers to physical material and items contained in this site that can be extracted. i.e. HTML, photographs, maps, software, films,
- Services – refers to the products and services offered within this website; tangible or intangible.
- Weka Travel is brand of Weka International
- Museum Tickets/admissions – refers to the fee charged in order to enter museums, archaeological sites and/or desired historical sites of
- Booking confirmation – is a confirmation sent via email or fax that confirms services have been confirmed and
- Reasonable Action – any action that remains within the laws of the country in which the action is taken and does not end in a financial loss for Weka International Ltd or any of its
- Clients/Buyers/ You – user that have accepted terms and agreements of Weka International Ltd and have or eventually will paid for services. This agreement will either be made after the booking process on our site by purchasing our travel products or with a member of our travel planning team via
- Drivers – refers to service professionals that operate cars, vans, helicopters, boats, buses and/or any vehicle powered by an energy
- Travel Planning – Planning of a vacation or holiday comprehensive of
- Trip – Travel Planning planned by Weka International Ltd
- Accommodation supplier – refers to any Hotel, B&B, lodge, Villa, Agriturismo or other Service Provider providing accommodation.
2. YOUR CONTRACT WITH THE WEKA INTERNATIONAL LTD.
When you make a booking with Weka Travel you undertake that you have the authority to accept and do accept these booking conditions on behalf of yourself and your party. These conditions in conjunction with the information set out in our website form the entire agreement between yourself and Weka Travel. Weka International Ltd reserves the right to change these terms and conditions without notice. Weka International Ltd is contracted solely as an intermediary between you and the Supplier (Service Provider) for any 3rd Party Services including and not restricting to Accommodation Suppliers, Tour Guides, Drivers, Bus companies, museums and sightseeing providers.
Prices are fixed at the time of booking are generally will not be subject to surcharges. The only exception to this will be an increase in our costs arising as a result of any government action including but not limited to new or increases such as VAT / IVA, City taxes for Accommodation, Local Council taxes for Bus entrances to cities.
Museum tickets/admissions are also subject to change without notice due to the addition and removal of exhibitions by the museums.
4. CHANGES BY CLIENTS
Changes must be administered at least 45 days prior to your service dates, apart from Accommodation and other Service Providers whom have cancellation and change policies. These changes will be subject to cancellation fees or Change of service fees. Other changes requested by the client can never be guaranteed, . Weka International Ltd will make the maximum attempt to assist clients with changes.
5. CANCELLATIONS BY CLIENTS ON TOURS, HOLIDAYS or INDIVIDUAL SERVICES; excluding flights.
Cancellations by the Buyer of any service or holiday provided by Weka International Ltd are 100% refundable up to 7 days after booking, subject to any costs incurred by Weka International ltd and less any cost incurred in refunding & transferring the money to the Buyer – this excludes any nonrefundable service which has been booked by the buyer.
Cancellations by the Buyer of any service or holiday provided by Weka International Ltd, between booking and 46days prior to the 1st Service date of the booking, will be subject to cancellation fees based on payments by the Buyer to Weka, and any supplier payments made by Weka to Service Providers. Weka will subject to each service provider’s terms and conditions. Weka International Ltd will also calculate a Cancellation fee based on a minimum of 30% excluding any non-refundable costs.
Cancellations by the Buyer of any service or holiday provided by Weka International Ltd 45 days to 0 days prior to the 1st service date of the booking.
All Cancellations must be made in writing to Weka International Ltd.
6. TRAVEL PLANNING INITIAL FEE
At the initiation of planning a trip Weka International Ltd reserves the right to request a non refundable deposit fee of €200. This fee is to assess the seriousness of a clients intentions to travel. Upon payment of the second deposit all fees assessed are subject to our cancellation policy detailed in article 7 below. Weka International Ltd reserves the right to not confirm or reserve reservation prior to the payment of the second deposit.
7. CANCELLATION POLICY FOR TRAVEL PLANNING
Travel Planning designates any services booked or facilitated outside of our guided tours found on our website. For example trains, hotels, reservation services, extraordinary requests and planning hours. Weka International Ltd. reserves the right to charge 100% cancellation fee, taken from the buyers deposit, to any trip cancelled. Weka International Ltd reserves the right to charge a 75% cancellation fee, taken from the buyers Second Final Travel Planning fee, to any trip cancelled 45 days prior to the arrival date. Weka International Ltd reserves the right to withhold the full cost of the vacation for any trip cancelled after 44 days prior to commencement date of the travel.
8. TRAVEL PLANNING AMENDMENTS BY BUYERS
Travel planning is a service administered prior to arrival of your desired destination therefore the service is completed upon payment. Once the second final Travel Planning fee is paid, Weka International Ltd will not offer a refund to the Travel Planning fee in your invoice. If you choose to amend or change your reservations Weka International Ltd as a service will do its best to make it happen without additional charges, but we reserve the right to assess amendments as cancellations if coinciding cancelation policy of hotels or service providers conflict. All other fees are subject to a 75% refund less admissions with the exception of 3rd party affiliates with conflicting terms and conditions as stated above ( Accommodation, Transportation, Entrance & Activity tickets and other 3rd party affiliates & Services).
9. CHANGES AND CANCELLATIONS BY WEKA INTERNATIONAL LTD.
Weka International Ltd reserves the right to change the start time, date, meeting point of any Guided tour or Cruise Excursion you book through Weka Travel. In the case you the user are dissatisfied with the change offered Weka International Ltd will offer its sincerest apology and a full refund including tickets where possible.
Weka International Ltd reserves the right to change, cancel or offer alternatives to any Service Provider cancellations should a Service Provider cancel a booking. Weka will provide the best support and options available to the BUYER. Any changes are subject to any new price by new Service Providers.
10 .A CHANGES AND DUE TO NATURAL DISASTERS, FORCE MAJEURE, OTHER REASONS BEYOND CONTROL OF WEKA INTERNATIONAL LTD.
Weka International Ltd reserves the right to change the start time, date, meeting point, full service or part service of any individual Guided City walking tour, or cruise excursion you book through Weka Travel, due to any natural disaster, force majeure or other reason that is beyond the control of Weka International Ltd. This includes among others, the closure of any entrance to locations, traffic disruptions, weather or any other reason due to a 3rd party.
Weka International Ltd is not liabile to get the clients to next destination port should they arrive late due any natural disasters, force majeure, traffic delays, or the client is not at the specified meeting point or time, or other circumstances deemed beyond the control of Weka International Ltd.
Weka International Ltd is not liable for any refund or credit of full holidays or partial holidays due to any natural disaster, force majeure or other reason that is beyond the control of Weka International ltd.
- Weka International Ltd accepts Visa and Paypal and Bank transfers.
- Weka International Ltd charge an additional fee for the booking of private and semi-private tours booked directly through the website without the use of Travel Planning.
- Weka International Ltd reserves the right to deny any refund request submitted less than 7 days prior to services or less than the period stated as per a service provider’s own terms and conditions or conditions as laid out in Weka International Ltd’s terms and conditions set out below.
- As stated prior, all requests for refunds must be made in writing and submitted via e-mail or fax.
- All faxes will be accompanied by an email address and email confirmation will be given to assure receipt of fax.
- Complete refunds can be offered only be discretion of management.
- Accommodation bookings are all subject to the payment, cancellation and changes Policy for each individual Accommodation provider. It is the oblication of the Buy/client to check with the accommodation provider for their terms and conditions. Upon acceptance of rates or bookings with Weka International Ltd, it is deemed the buyer/client has accepted the terms and conditions of the Accommodation provider.
12. INJURY, LOSS OR DAMAGES AGREEMENT BETWEEN USERS & WEKA INTERNATIONL LTD.
Weka International Ltd is not responsible for any loss, injury or damage that occurs during the use of its services i.e. robbery, car crash, illness, bedbugs or pests, damage to rooms or acts of God. Weka International Ltd is not responsible for the actions of its 3rd party service providers such as drivers, guides, accommodation providers, bus companies. Weka International Ltd will however assure that all drivers have the proper insurance policy and licensing for transporting tourists in their locality.
13. TRAVEL INSURANCE
Weka International Ltd advises all clients to purchase travel insurance in every circumstance possible. Weka International Ltd may at times recommend an insurance provider, but is not a certified seller of insurance and does not take responsibility for future disputes with any recommended seller of travel insurance. Weka International Ltd does assure users that it will not recommend any travel insurance provider that has caused reasonable problems for Weka International Ltd clients that Weka International Ltd is aware of.
14. WEKA INTERNATIONAL LIMITATIONS FOR USE OF WEBSITE www.WekaTravel.com
The information contained in this website is for general information purposes only. The information is provided by Weka International Ltd and while we endeavor to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose. Any reliance you place on such information is therefore strictly at your own risk.
In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website.
Through this website you are able to link to other websites which are not under the control of Weka International Ltd .We have no control over the nature, content and availability of those sites. The user is subject to these Terms & Conditions immediately upon entering our site.
Weka International Ltd is not in the business of selling personal information, content, data, or anything that is not property of Weka International Ltd. Weka International Ltd ensures the user & client that we will not intentionally sell your private data that may be collected intentionally or unintentionally by Weka International Ltd.
16. Weka International ltd acting as an Intermediary between the client/buyer and service providers (3rd party supplies such as Accommodation).
16.1: Scope of our services
By making a reservation of any Accommodation or other 3rd party Service provider through Weka International ltd, you enter into a direct (legally binding) contractual relationship with the Service provider (supplier). For example a Hotel is the service provider (supplier). From the point at which you make your reservation, we act solely as an intermediary between you and the Supplier, transmitting the details of your reservation to the relevant Supplier(s) and sending you a confirmation email for and on behalf of the Supplier. Weka International can make payments on your behalf to the Service provider (supplier) and depending on the agreement with the client/buyer can charge a fee or commission for this service.
When rendering our Service, the information that we disclose is based on the information provided to us by Suppliers. Although we will use reasonable skill and care in performing our Service, we will not verify if, and cannot guarantee that, all information as listed on the service provider’s website or information passed on from the Services supplier is accurate, complete or correct, nor can we be held responsible for any disruption to your stay or service whether it is a natural disaster, maintenance or repairs, breakdown, unclean or damaged rooms, bedbugs or other pest, lack of performance, missing services described by the supplier, or any other complaint that you as the client have with the services provided by the Service Provider (supplier / hotel or other). Each Supplier remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information and carrying out of their services as contracted between yourself the client and them the Supplier, regardless of whether or not Weka International Ltd (Intermediate) has paid on behalf of you the client. Weka International Ltd does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification or (star) rating of any Supplier (or its facilities, venue, products or services) made available. Weka International Ltd is Not liabable for any claims you the buyer have with the supplier/service provider/accommodation provider.
16.2 Payments, Cancellations, changes, no-show and fine print.
By making a reservation with a Supplier through Weka International (as an intermediary), you accept and agree to the relevant cancellation and no-show policy of that Supplier, and to any additional (delivery) terms and conditions of the Supplier that may apply to your visit or stay (including the fine print of the Supplier made available on each supplier’s website and the relevant house rules of the Supplier), including for services rendered and/or products offered by the accommodation provider (the delivery terms and conditions of an accommodation provider can be obtained with the relevant accommodation provider). Please check the (reservation) details of your product or service of choice thoroughly for any such conditions prior to making your reservation. Please note that a reservation which requires down payment or (wholly or partly) prepayment may be cancelled by Weka International Ltd without a prior notice of default or warning, insofar the relevant (remaining) amount(s) cannot be collected in full on the relevant payment date in accordance with the relevant payment policy of the Supplier and the reservation. Cancellation and prepayment policies may vary according to room type. Important information in your reservation confirmation for additional policies as may be applied by the Supplier (e.g. in respect of age requirement, security deposit, non-cancellation/additional supplements for group bookings, extra beds/no free breakfast, pets/cards accepted, reduced numbers of beds). Late payment, wrong bank, debit or credit card details, invalid credit/debit cards or insufficient funds are for your own risk and you shall not be entitled to any refund of any prepaid amount.
Please note that you may be charged for your cancellation in accordance with the accommodation provider’s cancellation, (pre)payment and no-show policy or not be entitled to any repayment of any (pre)paid amount. We recommend that you read the cancellation, (pre)payment and no-show policy of the accommodation provider carefully prior to making your reservation and remember to make further payments on time as may be required for the relevant reservation.
If you have a late or delayed arrival on the check-in date or only arrive the next day, make sure to (timely/promptly) communicate this with the Supplier so they know when to expect you to avoid cancellation of your reservation or room or charge of the no-show fee. Our customer service department can help you if needed with informing the Supplier. Weka International Ltd does not accept any liability or responsibility for the consequences of your delayed arrival or any cancellation or charged no-show fee by the Supplier.
In the case that Weka International ltd has made payments on the client’s behalf, and then the client makes any cancellation or delays of arrival or changes to the number of people booked for the service, there may fees and cancellations fees charged by Weka International ltd and will seek to recover any costs paid on your behalf or for works/services carried out.
If there is any disagreements between the Client/buyer and the suppliers, and Weka international ltd is requested by the client/buyer to make changes/payments on the clients/buyers behalf, Weka International Ltd is authorised to take whatever means necessary to recover these costs directly from the Client / Buyer and can cancel any other services until such payment has been recovered.
Weka International ltd, nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate (distribution) partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available our website or services shall be liable for (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of the Supplier, (iii) the services rendered or the products offered by the Supplier or other business partners, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use of our booking systems, or (v) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the Supplier or any of our other business partners (including any of their employees, directors, officers, agents, representatives or affiliated companies) whose products or service are (directly or indirectly) made available, offered or promoted on or through the Platform, including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.
Whether or not the Supplier has charged you for your room, product or service, or if we are facilitating the payment of the (room/reservation) price, you agree and acknowledge that the Supplier is at all times responsible for the collection, withholding, remittance and payment of the applicable taxes due on the total amount of the (room/reservation) price to the relevant tax authorities. Weka International ltd is not liable or responsible for the remittance, collection, withholding or payment of the relevant taxes due on the (room/reservation) price to the relevant tax authorities.
